Terms of Use

These Terms of Use ("Terms") are an agreement between you and Bluetrace Entertainment, LLC ("Bluetrace," "we," "us") for your use of Football Pick'em at pickem.bluetrace.net (the "Service"). By creating an account or using the Service you agree to these Terms, the league rules shown in the Service (Support → Rules), and the Privacy Policy. If you don't agree, don't use the Service.

1. What Football Pick'em is, and isn't

Football Pick'em is software for running a private weekly football pick'em pool among people who know each other. Each pool ("league") is organized and run by its Commissioner, who is a user, not Bluetrace.

Bluetrace does not organize, sponsor or operate any pool, does not set entry fees or prizes, and is not a party to any arrangement among a league's members.
Bluetrace never receives, holds, transfers or verifies money. Entry fees and prizes, if any, are paid directly between members through services such as Venmo, Cash App, PayPal or Zelle, outside the Service and under those services' own terms. The Service only records what a Commissioner or player reports, and a Commissioner confirms each payment by hand.
Bluetrace takes no fee, commission or share of any entry fee or prize.
Football Pick'em is not affiliated with, endorsed or sponsored by the National Football League, any team, ESPN, or any payment service. Team names are used only to identify games.

2. Who can use it

You must be at least 18 years old and located in the United States. You are responsible for making sure that taking part in a pool, including any entry fee, is lawful where you live. The Service may not be used where pools with entry fees are prohibited.

3. Your account

You sign in with your email address and a password. Keep your password private; you're responsible for activity on your account. One person, one account; an account can belong to several leagues. Give accurate information, and keep your email address current, since it's how you recover your account. You can delete your account at any time (My Profile → Delete my account); see the Privacy Policy for what happens to your league history.

4. Commissioners

A Commissioner can create a league, set its join code and settings (entry fee, lock rule, tiebreak rule), add and remove members, enter picks from paper sheets, correct scores, and record payments and payouts. Every such change is recorded in the league's change log. By acting as a Commissioner you agree to:

run your league honestly, apply its rules consistently, and pay out every prize the league's rules say is owed;
collect and pay out any money yourself, directly with members, and comply with the law that applies to your pool;
keep members' contact details private and use them only to run the league; and
make another member Commissioner before you leave or delete your account.

Bluetrace is not responsible for a Commissioner's decisions, errors, or failure to pay. Disputes about a pool are between its members and its Commissioner.

5. Acceptable use

Don't: use the Service for anything unlawful, including illegal gambling; create accounts for other people without their permission; access another league or account; probe, scrape, overload or interfere with the Service; share a league's join code publicly; harass anyone; or upload content (such as a league logo) that you don't have the right to use or that is offensive.

6. Scores and availability

Scores come from a third-party sports data feed and are provided as-is. They can be delayed, wrong or unavailable, and a Commissioner can correct a score by hand. The Service may be interrupted, changed or discontinued. We don't guarantee it will always be available or error-free, and results in the Service are only as accurate as the scores and entries recorded.

7. Content and ownership

Bluetrace owns the Service, its software and its design. You keep ownership of what you provide (such as a league name or logo) and give Bluetrace a limited licence to host and display it for your league while the Service operates. Team names and other marks belong to their owners.

8. Ending use

You can stop using the Service or delete your account at any time. We may suspend or close an account or league that breaks these Terms or the law, or to protect other users or the Service.

9. Disclaimers and limits

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT THE LAW ALLOWS, BLUETRACE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR ANY ENTRY FEE, PRIZE, PAYMENT OR LOSS ARISING FROM A POOL OR BETWEEN USERS. BLUETRACE'S TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO $50.

10. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.

11. Changes

We may update these Terms. We'll post the new version with its effective date, and for significant changes we'll give notice in the Service or by email. Continuing to use the Service after the effective date means you accept the new Terms.
